Human Motion Data, Inc. ("HMD," "we," "us," or "our") operates the Human Motion Data mobile application, associated web portals, websites, and data-collection programs. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal data.
This Privacy Policy applies to contributors, homeowners or authorized occupants, additional adults who may be present during collection, website and portal users, business contacts, and other individuals whose personal data may be processed through our services.
This Privacy Policy is a notice and does not replace any contributor agreement, participant consent, home-access agreement, assignment brief, customer agreement, or project-specific privacy notice. Where consent or another specific authorization is required, HMD obtains it through the applicable written, electronic, or in-app process.
Data controller. For the processing described in this Privacy Policy, HMD generally determines the purposes and means of processing and acts as the data controller or personal information controller, except where a project-specific notice or agreement states otherwise.
Depending on how you interact with HMD, we may collect the following categories of personal data:
Identity, eligibility, and account information. This may include your name, username, email address, telephone number, country of collection, age or adult-eligibility attestation, electronic signature or acceptance record, agreement version, acceptance timestamp, platform identifier, and account credentials.
Payment, tax, and administrative information. This may include payout destination information, payment-provider identifiers, payment history, tax information where required, compensation records, and records needed to administer contributor relationships.
Project Data. Project Data may include video, images, motion data, accelerometer, gyroscope and magnetometer data, timestamps, device and camera information, task information, annotations, labels, quality-control records, reviewer decisions, and other materials captured, submitted, or generated in connection with a data-collection assignment.
Project Data may depict a contributor's hands, arms, body, clothing, movements, work performance, physical surroundings, household objects, and portions of a residential or other authorized environment. It may also incidentally contain personal data relating to homeowners, residents, visitors, or other individuals.
HMD does not collect or use standard Project Data for the purpose of uniquely identifying or authenticating individuals. Any project involving biometric identification or authentication will be subject to a project-specific notice, applicable agreement, and any additional lawful basis or consent required by law.
Audio and voice data. Audio is part of HMD's standard data collection and may be recorded in synchronization with video, motion data, and related sensor data. Audio may include environmental and household sounds, sounds created by tools, appliances, objects, and task performance, contributor speech or narration, and incidental speech or voices of other authorized individuals in the recording area.
Audio may constitute personal data when an individual is identifiable by voice, speech content, or surrounding context. HMD does not intentionally record private conversations or spoken information from individuals who have not received any notice and provided any permission or consent required by applicable law and HMD procedures.
Premises and permission information. For collection performed in a residence or other third-party location, we may collect the name and contact information of an authorized occupant, the collection location, designated and excluded areas, visit information, applicable permissions, and additional-adult consent records.
Technical and usage information. This may include IP address, device type and model, operating system, application version, camera configuration, upload timestamps, authentication records, security logs, diagnostic information, account activity, analytics or measurement events, and interactions with HMD systems.
Communications. We may retain support requests, complaints, appeals, privacy requests, incident reports, survey responses, and communications with contributors, participants, customers, and business contacts.
Derived and de-identified information. We may generate annotations, classifications, quality scores, statistical information, pseudonymous identifiers, aggregated information, de-identified data, synthetic data, and other information derived from Project Data.
We collect personal data:
HMD may process personal data and Project Data for the following purposes:
HMD does not use contributor Project Data for behavioral advertising or cross-context advertising.
The lawful basis for processing depends on the individual, jurisdiction, category of data, and processing purpose. HMD may rely on:
Performance of a contract. We process contributor, account, assignment, payment, and Project Data as necessary to administer and perform contributor and customer agreements.
Consent. We rely on documented consent where required for recording, processing a person's likeness or voice, collection in a residence, processing sensitive personal data, disclosure, international transfer, public release, or another applicable purpose.
Legitimate interests. Where permitted by applicable law, we may process personal data for legitimate interests such as securing our systems, preventing fraud, conducting quality control, maintaining provenance records, administering business relationships, and establishing or defending legal claims. We do not rely on legitimate interests where the individual's rights override those interests or where applicable law requires consent.
Compliance with law. We may process personal data to comply with tax, accounting, labor, privacy, security, regulatory, court, and law-enforcement obligations.
Legal claims and protection of persons. We may process personal data where necessary to establish, exercise, or defend legal claims or to protect the safety, rights, or property of individuals, HMD, customers, or the public.
Where consent is the relevant lawful basis, an individual may withdraw consent subject to applicable law. Withdrawal does not affect processing lawfully completed before the withdrawal.
HMD commercially licenses and may sublicense Project Data and related metadata to customers, licensees, authorized distribution partners, and research or commercial collaborators for artificial-intelligence, machine-learning, robotics, computer-vision, research, evaluation, and product-development purposes.
Commercially licensed Project Data may include synchronized audio and video, including environmental sounds, task-performance sounds, contributor speech or narration, and authorized voice data, as described in the applicable agreements.
Project Data may constitute personal data when an individual or location remains reasonably identifiable. HMD therefore does not represent all Project Data as anonymous merely because names or account information have been removed.
Customer datasets use pseudonymous contributor identifiers. HMD does not include contributor names, direct contact information, account passwords, payment credentials, tax information, precise residential addresses, or precise GPS coordinates in customer datasets unless a specific project requires that information, the disclosure is expressly described in the applicable notice or agreement, and a valid lawful basis exists.
HMD does not commercially sell contributor account credentials, payment information, tax information, or direct contact information. We may disclose those categories to service providers, authorities, advisers, or other recipients where necessary for administration, payment, security, legal compliance, or another purpose described in this policy.
Depending on the applicable jurisdiction, commercial licensing or disclosure of identifiable Project Data may be characterized as a sale, transfer, disclosure, or other regulated processing activity. Where an applicable law provides an opt-out or similar right, HMD will provide and honor that right as required by law.
HMD may disclose personal data to the following categories of recipients:
Customers and licensees. We may provide Project Data, associated metadata, annotations, and provenance information to customers and licensees for the purposes authorized by the applicable agreements.
Prospective customers and commercial partners. We may provide limited, gated, or curated samples for evaluation, diligence, demonstrations, or commercial discussions.
Cloud, infrastructure, analytics, and software providers. These may include hosting, storage, database, authentication, communications, analytics or measurement, security, file-transfer, application-distribution, and software-development providers.
Payment providers. We may provide information necessary to process contributor payments through banks, electronic-wallet providers, or payment platforms selected or approved for the applicable program.
Review, annotation, and quality-control personnel. HMD employees, independent contractors, reviewers, annotation providers, and quality-control providers may access Project Data where necessary for authorized work.
Professional advisers and insurers. We may disclose information to attorneys, accountants, auditors, consultants, insurers, and similar advisers.
Corporate transaction participants. Information may be disclosed in connection with financing, investment, acquisition, merger, reorganization, sale of assets, insolvency, or due diligence relating to such a transaction.
Governmental and legal recipients. We may disclose information to regulators, courts, law-enforcement authorities, or other persons where required or permitted by law or necessary to protect rights, safety, or property.
Recipients are provided only the information reasonably necessary for the applicable purpose and are subject to contractual, professional, or legal obligations where appropriate.
HMD may use third-party providers for cloud hosting, storage, databases, authentication, analytics and measurement, payment processing, email and communications, application distribution, file transfer, security, quality control, annotation, and related operational services.
Current material providers may include Amazon Web Services, Google Firebase for limited app analytics or measurement, and the payment provider selected for a contributor's payment. Some providers act as HMD processors or service providers, while others may act as independent controllers under their own privacy notices. AWS's privacy practices are described in the AWS Privacy Notice.
Contributors must record only in authorized locations and must obtain all permissions, notices, and consents required by applicable law and HMD procedures.
Additional adults who are expected to remain present and be visible, audible, or otherwise identifiable in a recording area must receive the applicable notice and provide any required consent or authorization. Individuals who do not wish to be recorded must be excluded from the recording area. If an unauthorized, unconsented, or objecting person enters the recording area or begins speaking within recording range, the contributor must pause, reposition, exclude that person, or stop recording.
Contributors must avoid capturing government identification, financial records, medical information, passwords, account credentials, precise addresses, private device screens, confidential information, or other unnecessary sensitive personal data.
HMD may reject, restrict, redact, mute, crop, blur, quarantine, or delete recordings that contain unauthorized persons, prohibited sensitive information, or other privacy or legal risks.
HMD's standard data collection includes audio recorded in synchronization with video and related sensor data. Audio is an important part of the Project Data and may include environmental sounds, object interactions, appliance and equipment sounds, sounds generated during task performance, contributor speech or narration, and speech or voices of other authorized individuals in the recording area.
HMD may process audio for capture verification, synchronization, quality control, annotation, transcription where applicable, acoustic-event analysis, speech and language analysis, audio-visual understanding, multimodal artificial-intelligence and robotics training and evaluation, research, product development, customer demonstrations, licensing, sublicensing, distribution, and commercialization.
Contributors are informed that audio is recorded and must provide the applicable contractual authorization and consent for the recording and downstream use of their voice, speech, task performance, and other audio captured while they perform collection assignments.
Any other adult who is expected to be visible, audible, or identifiable in the recording area must receive any notice and provide any permission, acknowledgment, or consent required by applicable law and HMD procedures before collection begins. Individuals who do not wish to be recorded must remain outside the recording area. If an unauthorized or objecting individual enters the recording area or begins speaking within recording range, the contributor must pause, reposition, exclude that individual from capture, or stop recording as reasonably appropriate.
Contributors must avoid recording unrelated private conversations, confidential discussions, passwords, financial-account information, medical information, government-identification information, or other unnecessary sensitive spoken information.
If unauthorized or unnecessary speech or other audio is inadvertently captured, HMD may quarantine, review, restrict, redact, mute, segment, or exclude the affected material as required by applicable law, contract, and HMD procedures. HMD may use targeted remediation where feasible rather than removing unrelated environmental, task, or object-interaction audio.
Approved audio may be retained, processed, disclosed, and commercially licensed as part of the Project Data in accordance with this Privacy Policy, the applicable contributor or participant agreements, and HMD's customer agreements.
A project requiring structured narration, scripted speech, language-specific collection, voice annotation, or another specialized audio modality may be subject to additional project-specific instructions, notices, or consent terms.
HMD retains personal data only for as long as reasonably necessary for the purposes described in this policy, the applicable agreements, and applicable law.
Approved Project Data. Approved Project Data may be retained on a long-term basis while it remains part of HMD's datasets, is commercially available, supports customer licenses, is needed for research or development, or is required for provenance, audit, security, dispute-resolution, and legal purposes.
Agreement, consent, and provenance records. HMD retains contributor agreements, consent records, acceptance timestamps, rights records, source provenance, quality-control records, delivery records, and related documentation for at least as long as the associated Project Data is retained and for any additional period needed to meet legal, contractual, audit, or limitation-period requirements.
Rejected or incomplete recordings. Rejected, incomplete, or unusable recordings are retained only for the period reasonably necessary to determine final disposition and administer appeals, investigations, fraud prevention, security incidents, payment disputes, legal obligations, and backup rotation. They may then be archived, restricted, made inaccessible, or deleted in accordance with HMD's retention schedule and applicable obligations.
Account, payment, and tax records. These records are retained for the duration of the relationship and for any additional period required for payment, tax, accounting, fraud-prevention, dispute, or legal purposes.
Security and operational logs. These records are retained for the period reasonably necessary to secure HMD systems, investigate incidents, prevent misuse, and meet legal obligations.
When deletion is required, HMD will delete or restrict active copies and allow backup copies to expire or be overwritten through the applicable backup-retention process, unless continued retention is legally permitted or required.
Information that has been irreversibly anonymized so that it no longer constitutes personal data may be retained indefinitely. Pseudonymized information remains subject to this policy where it can still reasonably be linked to an individual.
Depending on applicable law, individuals may have the right to:
HMD may request information reasonably necessary to verify the identity and authority of a requester. We will respond within the period required by applicable law.
When a verified individual withdraws consent, HMD will stop future collection and determine whether consent is the relevant lawful basis for the affected processing. If no other lawful basis permits continued processing, HMD will delete, block, restrict, or otherwise address the affected personal data as required by law.
Where no lawful basis remains, HMD will suppress affected identifiable source recordings from all future releases. HMD will notify relevant processors, customers, or licensees and require corresponding action where applicable law or the governing contract requires it.
Withdrawal does not affect the lawfulness of processing completed before withdrawal. Depending on technical feasibility and applicable law, HMD may not be able to remove information already incorporated into irreversibly anonymized datasets, aggregate information, synthetic data, trained models, model parameters, or outputs that no longer constitute personal data. In those circumstances, HMD will implement other measures required by applicable law and will prevent further unauthorized use or release of identifiable source data.
Certain requests may be denied or limited where continued retention or processing is permitted or required for contract performance, legal compliance, fraud prevention, security, payment administration, legal claims, or another lawful purpose. HMD will explain an applicable limitation where required by law.
HMD will not unlawfully discriminate or retaliate against an individual for exercising a privacy right. Where applicable law permits, an authorized agent may submit a request on an individual's behalf, subject to verification of the agent's authority and the identity of the relevant individual.
HMD's contributor App and standard contributor program are limited to individuals who are at least 18 years old and have the legal capacity to enter into the applicable agreement. Contributors generally perform services as independent contractors, not as HMD employees.
Minors may not create contributor accounts, execute contributor agreements, or act as data collectors.
Contributors must keep minors out of designated recording areas and must not intentionally record a minor's image, voice, speech, or other personal data unless HMD has separately approved a specific project and all legally required notices, parental or guardian permissions, safeguards, and project-specific procedures have been completed.
If HMD learns that a minor was recorded or provided personal data without the required authorization, HMD will investigate and delete, restrict, redact, or otherwise address the data as required by applicable law.
HMD is based in the United States and may store or process personal data in the United States, the country of collection, and other jurisdictions in which HMD, its customers, or its service providers operate.
Privacy laws in those jurisdictions may differ from the law in the individual's home country. Where applicable law requires safeguards for an international transfer, HMD uses contractual, organizational, technical, or other legally recognized safeguards appropriate to the transfer.
Project-specific agreements or country-specific notices may provide additional information concerning international transfers.
HMD may use automated tools to assist with upload validation, technical review, quality flagging, duplication detection, labeling, annotation, data organization, and security monitoring.
Automated tools may produce flags or recommendations that are reviewed or acted upon by authorized personnel. Where applicable law grants a right to human review of a decision having legal or similarly significant effects, HMD will provide that review as required.
HMD does not use Project Data as the sole basis for an automated decision that produces legal or similarly significant effects on a homeowner, resident, visitor, or other person appearing in a recording without any additional notice or lawful basis required by law.
HMD uses reasonable and appropriate administrative, technical, and physical safeguards designed to protect personal data against unauthorized access, alteration, disclosure, loss, destruction, and misuse.
Measures may include encrypted transmission, access controls, scoped credentials, authentication controls, logging, separation of account information from customer delivery data, secure cloud infrastructure, controlled file transfer, confidentiality obligations, and incident-response procedures.
No system can be guaranteed completely secure. Individuals should promptly report suspected unauthorized access, lost devices, mistaken uploads, compromised accounts, or other privacy or security incidents.
Where a personal-data breach triggers notification obligations, HMD will notify affected individuals, regulators, customers, or other parties as required by applicable law and contract.
HMD may update this Privacy Policy to reflect changes in its services, processing activities, contractual arrangements, technology, or legal obligations.
We will update the effective date and retain prior versions or make them available upon request. If a change materially expands the purposes, categories of data, recipients, or other processing previously disclosed, HMD will provide appropriate notice and, where required by applicable law, obtain fresh consent or provide an opportunity to object or withdraw consent before applying the change.
A revised Privacy Policy will not by itself retroactively authorize processing that required consent or another specific authorization when the data was originally collected.
